There are two different “type” of rebuilding that can be done using the information from Archive.org. The first, could land you in trouble if any of the content is protected by copyright as it involves making an exact replica of the site as it was. If any of that content was protected by copyright then you are infringing on that copyright. The second is what I call a “Update Rebuild” where you rebuld the site with the same pages, using a new layout/theme and rewriting all of the content enough so that its not the same as what was on the site, but is close enough that Google and any real users still think it is the same site.
